The British Court of Appeal ruled on Tuesday that the decision by a Cypriot court, in connection with the Apostolides v Orams property ownership case, must stand and the Cypriot ruling must be executed.
The Cypriot court had ruled that the Orams must pay compensation to Apostolides, demolish the holiday home they built on his land in the Turkish occupied village of Lapithos, halt all intervention on the said property and deliver it to its legal owner.
Cyprus House President Marios Garoyian has described as a ‘milestone’ the British Court ruling noting it sends a message that the Greek Cypriot side will not compromise with either illegalities or violation of its citizen’s rights.
Garoyian said “It is a milestone decision which is associated with many decisions of European courts and offers the necessary weapons to the Greek Cypriot side to claim what it is entitled.”
The ruling could affect thousands of other holiday owners in Northern Cyprus who bought land which once belonged to Cypriots forced to flee after the invasion in 1974.
Speaking after the ruling Mrs Oram said she believed they had unwittingly become involved in a complex political situation between the divided communities. She said she did not know how the judgements would be enforced in the Turkish controlled part of the island.
The Orams had bought the land from a third party who claimed to have acquired it from the Turkish Republic of Northern Cyprus, a state recognised only in Turkey.
